Job Description

Purpose of the Role Managing the IPR portfolio of the company and closing commercial agreements as per business requirements while keeping in mind risk mitigation and adherence to legal provisions. Principal Responsibilities Independently handling Trademark filings and proceedings like making Trademark Search Reports. Protecting the Trademarks of the company Tracking of similar Trademarks (filed by other parties) in Trade Marks Journal. Attending hearing before the Trademark registry as and when required Searching for Infringing Trademarks/Copyrights and sending them Cease and Desist notice/Legal notice, Rejoinder and Settlement letter with respect to infringement of trademarks/copyrights Drafting, Vetting and Reviewing various agreements like Leave and License Agreements, Manufacturing agreements, Manpower agreements, Non-Disclosure Agreements, Marketing Agreements, Service Agreements,Indemnity Bond, Affidavits etc. Drafting contracts, documents, notices etc so as toprotect the company\'sinterest. Assisting in Litigation matters and attending matters in High Court/ District Courts, briefing advocates of the cases/complaints Drafting of notices and replies to notices for any issue including recovery notice, notice undue Sec 138 of NIA, notices under Consumer Protection Act etc Researching and providing opinion to business on legal issues and interpretation of statutes, researching for case laws and citations. Coordinating with internal stakeholders for necessary information gathering maintaining MIS with respect to litigation and Trademarks. Drafting and filing oppositions/counter statements/evidence against same/similartrademarks filed against/by third party new trademark applications, Renewals, Reply to Examination Reports & Evidence etc and follow up till registration of the trademark. Education and Experience Education : LLB 5-8 years ofpost qualification experience, with emphasis on commercial agreement drafting and IPR protection Proven track record of success in securingTrademarks and Copyright protection for the company.
