Position Summary: We are seeking an experienced Immigration Specialist to manage and oversee EB-1A (Extraordinary Ability) applications. This role is vital to supporting individuals who wish to immigrate to the United States based on extraordinary abilities in fields such as sciences, arts, business, education, or athletics. The Immigration Specialist will work directly with clients to prepare comprehensive applications, ensuring that all eligibility criteria are met and that each case is presented with compelling evidence of extraordinary ability. Key Responsibilities: * EB-1A Visa Application Management:

  • Lead the preparation, submission, and management of EB-1A petitions for clients across various fields of extraordinary ability.
  • Assess clients? qualifications and advise on the most suitable visa options based on their unique professional profile and achievements.
  • Develop customized strategies for building and presenting cases that highlight clients? extraordinary accomplishments in alignment with USCIS (United States Citizenship and Immigration Services) criteria.
  • Document Preparation and Review:
  • Collaborate with clients to collect and review supporting documentation, including awards, publications, press releases, recommendation letters, and other forms of recognition.
  • Prepare and draft strong petitions that demonstrate eligibility under EB-1A criteria, including evidence of sustained national or international acclaim.
  • Ensure that all required forms (e.g., Form I-140) are accurately completed, well-organized, and submitted in a timely manner.
  • Client Consultation and Guidance:
  • Provide expert legal and procedural advice to clients regarding the EB-1A visa application process, eligibility requirements, and strategies for maximizing the strength of their case.
  • Offer personalized consultation to clients, including artists, researchers, business executives, and athletes, to understand their career achievements and potential for immigration eligibility.
  • Counsel clients on obtaining strong recommendation letters from industry experts, organizations, or influential figures in their field.
  • Case Strategy Development:
  • Develop and implement tailored strategies to present a compelling case for clients based on their extraordinary ability and achievements.
  • Work closely with clients to highlight specific accomplishments such as awards, memberships in elite organizations, patents, and media coverage.
  • Analyze complex cases, identify gaps in evidence, and propose solutions to strengthen the case, including suggestions for obtaining additional documentation.
  • Liaison with USCIS and Other Authorities:
  • Communicate effectively with USCIS, U.S. consulates, and other government agencies to track the status of EB-1A applications.
  • Respond promptly to Requests for Evidence (RFEs) issued by USCIS, providing additional documentation and clarification as needed.
  • Manage any administrative appeals or denials, including preparing and submitting responses to Notices of Intent to Deny (NOID) or other challenging scenarios.
  • Research and Legal Updates:
  • Stay up-to-date with changing immigration laws, regulations, and policies that affect the EB-1A visa category and other employment-based immigration processes.
  • Conduct research on emerging trends, new interpretations, and precedents in EB-1A adjudications to ensure that applications are aligned with current USCIS standards.
  • Attend immigration law seminars, webinars, and conferences to enhance professional knowledge and expertise.
  • Cross-Department Collaboration:
  • Work closely with other immigration professionals (e.g., attorneys, paralegals) to ensure that EB-1A petitions are handled smoothly and efficiently.
  • Provide guidance on preparing additional visa types or transition processes once the EB-1A petition is approved, such as Adjustment of Status (Form I-485).
