Job Description

The opportunity to work as an integral part of the Legal team of a leading entity in the real estate spaceReporting to the Director, you will be responsible for:

• Understanding of real estate law relevant to the state of Karnataka/Maharashtra
• Drafting of real estate transaction related documents including term sheets, agreements to sell, sale deeds, lease deeds, release deeds, joint development agreements, loan agreements, powers of attorney, deeds of declaration etc.
• Facilitating and attending if required, registration of residential projects with RERA and for periodic filings with RERA.
• Title due diligence for properties and where required, coordinating with external legal counsels on the same. Ability to identify gaps in title and deliberate with Legal Lead on possible risk and mitigation.
• Assisting other departments in obtaining requisite approvals from relevant statutory authorities and preparation of periodic statutory filings. [ does legal do this or liaison?]
• Coordinating with respect to payment of stamp duty and registration charges and registration of deeds and documents with the Sub Registrar\'s office.
• Maintaining title documents (hard and digitized) and regular update of revenue related documentation relevant to the company\'s projects.
• Co-ordinating with external counsels on all consumer related disputes including cheque bounce issues, RERA proceedings and civil disputes of all nature including land related proceedings, money recovery suits, commercial suits, declaratory suits, proceedings under the Insolvency and Bankruptcy Code, 2016 etc. Drafting /reviewing the pleadings to be filed on behalf of the Company.
• Familiarity with criminal law.
• Functional knowledge of mediation and arbitration proceedings.
• Coordinating with external legal counsel and briefing senior counsel on legal proceedings involving the company.
• Familiarity with share purchase agreements, shareholders\' agreements, escrow agreements, business transfer agreements, non disclosure agreements etc.
• Functional knowledge of company law compliances including FEMA related compliances with respect to real estate sector.
