Protect the interest of company in a rather complicated business environment, advise the management on day to day legal issues and to legally safeguard the interest of the organization and help for timely achievement the goals of the organization.Litigation Specialist would work closely with the commercial team, and various business units and other functions on a broad range of legal matters. Candidate should be capable of exercising independent judgment and management of reasonably complex legal issues and litigations.
Major Areas of Responsibilities
Litigations
Assessing dispute threats and opportunities; planning appropriate tactics, and strategies;
Legal Research on various Acts and statues.
In house drafting of legal documents and pleadings like petitions, plaints, written statements etc. in consultation with external counsels & by providing all relevant documents / facts etc to our counsel
Planning & Strategizing Legal actions by briefing advocates, Senior Counsels.
In depth knowledge handling IPR Infringement and passing off actions
Good exposure in dealing with Arbitration matters/ NCLT matter and high stake value litigations.
Developing unique strategies to reduce OPEX.
Evaluating various demands raised by the Authorities & challenging if reqd..
Dealing with various courts and Tribunals and Quasi Judicial bodies.
To Monitor the settlement of Consumer cases and to ensure customer satisfaction by giving proper reply of the legal notices in case the same is required.
Out of court settlements in consumer & recovery cases
Recovery initiatives thru mediation
Preparing, maintaining and reporting various MIS on litigations
Contracts
Advising, Drafting and negotiating various types of contracts, agreements such as collaboration and JV agreements, NDA, MOU, Deeds, guarantees and indemnities, Master IT agreements, IPR assignments, Lease, Leave and license, mortgage, POA, settlements deeds etc.
Negotiation of all types of contracts and closure on TAT
Providing specialist commercial legal advice for the achievement of commercial objectives,
Documents archiving and retrieval
Minimizing risk and maximizing negotiation strength & opportunities.
Person Specifications
Essential Qualification:
Candidate should be law graduate with minimum 12-14 years of experience drafting of legal documents and pleadings like petitions, plaints, written statements etc. in consultation with external counsels & by providing all relevant documents / facts etc to our counsel.
