Key Responsibilities:
Real Estate Transactions:
Draft, review, and negotiate contracts, including sales agreements, lease agreements, development agreements, and joint venture contracts.
Oversee property acquisitions and disposals, ensuring all transactions comply with local real estate laws and regulations.
Conduct due diligence for property acquisitions, including title searches, reviewing property documents, and resolving legal issues related to property rights and encumbrances.
Legal Compliance & Regulatory Matters:
Ensure compliance with all local, state, and national real estate laws and regulations.
Stay updated with legal changes in real estate laws, zoning laws, land acquisition regulations, environmental regulations, and other pertinent statutes.
Advise management on legal risks and compliance issues related to real estate projects.
Dispute Resolution & Litigation:
Represent the company in real estate-related disputes, mediations, and court proceedings.
Manage litigation processes, working with external legal counsel as needed.
Resolve landlord-tenant issues, title disputes, construction-related claims, and other real estate legal matters.
Contract Management:
Draft and review contracts related to real estate sales, construction, financing, and project management.
Negotiate terms and conditions of various contracts to protect the company's legal interests.
Manage contract renewals, amendments, and compliance.
Land Acquisition & Development:
Assist in the legal aspects of land acquisition, including reviewing title deeds, legal clearance, and ensuring proper registration.
Handle zoning and planning approvals, liaising with government authorities when required.
Provide legal input on project development and construction agreements.
Risk Management:
Identify potential legal risks in real estate transactions and provide strategic solutions to mitigate them.
Conduct legal audits and assessments to minimize exposure to risks and ensure smooth operations.
Corporate Legal Advisory:
Provide general legal advice on real estate financing, partnership agreements, joint ventures, and real estate investments.
Collaborate with the finance and business development teams to ensure that legal considerations are integrated into strategic decisions.
Contractual Negotiations:
Negotiate with external parties such as contractors, vendors, landowners, and government officials to secure the best possible legal outcomes for the company.
Qualifications & Skills:
Education: Bachelor's degree in Law (LLB), with additional qualifications such as an LLM or specialization in real estate law being preferred.
Experience: 5-7 years of legal experience, with a significant focus on real estate law, property transactions, and real estate development projects.
Skills:
In-depth knowledge of real estate laws, contracts, and legal regulations.
Strong negotiation and drafting skills, with the ability to handle complex legal documents.
Ability to work on multiple projects simultaneously while maintaining attention to detail.
Excellent communication, problem-solving, and conflict-resolution skills.
Strong organizational and time management abilities.
Preferred Experience:
Hands-on experience in real estate transactions, property due diligence, and land acquisition processes.
Familiarity with zoning laws, building regulations, and land use laws.
Litigation experience in real estate disputes would be a plus.
