Roles and Responsibilities
1. Contract Drafting and Review:
o Draft, review, and negotiate contracts related to construction contracts and other related amendments.
o Ensure that all contracts comply with legal requirements and company policies.
o Identify potential risks and suggest amendments to mitigate these risks.
2. Legal Compliance:
o Ensure that all contracts and agreements comply with local, state laws and regulations.
o Stay updated on relevant legal and regulatory changes that may impact the company's operations.
o Coordinate with legal counsel to address complex legal issues.
3. Contract Management:
o Maintain an organized system for contract documentation and records.
o Track contract deadlines, renewals, and obligations to ensure compliance and timely execution.
o Develop and implement contract management policies and procedures.
4.Negotiation:
o Lead or support contract negotiations with vendors, contractors, clients, and other stakeholders.
o Work to achieve favourable terms and conditions that align with the company's strategic and financial goals.
5.Risk Management:
o Identify and assess risks associated with various contracts and transactions.
o Develop risk mitigation strategies and ensure that these are incorporated into contracts.
o Coordinate with insurance providers to ensure appropriate coverage is in place for various projects.
6. Collaboration and Communication:
o Work closely with project managers, finance teams, legal advisors, and other departments to ensure contract terms are understood and met.
o Communicate contract-related information effectively to all relevant stakeholders.
o Provide training and guidance to team members on contract-related matters.
7. Vendor and Contractor Management:
o Evaluate and select vendors and contractors based on their ability to meet contractual obligations.
o Monitor performance and compliance of vendors and contractors with the terms of their contracts.
o Address any issues or disputes that arise during the course of the contract.
8. Financial Analysis:
o Conduct financial analysis related to contracts to ensure cost-effectiveness and budget compliance.
o Collaborate with the finance department to align contract terms with financial goals and constraints.
9. Project Support:
o Support project teams by providing contract-related guidance and ensuring all contractual obligations are met.
o Assist in the preparation of project bids, proposals, and tenders.
10. Dispute Resolution:
o Manage and resolve any disputes or conflicts arising from contractual relationships.
o Work with legal counsel and relevant parties to negotiate settlements or pursue legal remedies if necessary.
11. Documentation and Reporting:
o Prepare and maintain detailed reports on contract status, compliance, and performance.
o Ensure all contract documentation is accurately recorded and easily accessible for reference.
12. Continuous Improvement:
o Continuously evaluate and improve contract management processes and practices.
o Stay informed about industry best practices and implement changes to enhance efficiency and effectiveness.
Skills and Qualifications
• Educational Background: B.E. Civil, Specialised courses in Contracts. Degree in Law or a legal background is often preferred.
• Experience: Several years of experience in contract management, preferably within the real estate or construction industry.
• Analytical Skills: Strong analytical skills to assess risks, financial implications, and compliance issues.
• Negotiation Skills: Excellent negotiation and communication skills to manage stakeholder expectations and secure favourable terms.
• Detail-Oriented: High attention to detail to ensure accuracy and completeness in contract documentation and management.
• Organizational Skills: Strong organizational skills to manage multiple contracts and deadlines effectively.
• Knowledge of Real Estate Law: In-depth understanding of real estate law, regulations, and industry practices.
• Problem-Solving Skills: Ability to address and resolve conflicts and disputes efficiently.
